- OFFICIAL GENERAL CONTEST RULES: Any individual who enters, attempts to enter, or in any way participates or attempts to participate in this giveaway (“Contest”) conducted by KIPP Texas Public Schools (each such individual hereinafter referred to as “Participant”) agrees to be bound by the terms and conditions provided in these Rules, as well as by KIPP Texas Public Schools’ interpretation of these General Rules which are final and binding in all matters relating to this Contest, and represents and warrants that they meet the eligibility requirements.
- ENTRY: No purchase necessary to enter or win. A purchase will not improve your chances of winning. Participants will enter by submitting a referral via the entry form. Participants must complete all required fields accurately, including FIRST and LAST NAME, EMAIL, STUDENT’S NAME, STUDENT’S SCHOOL NAME, STUDENT’S CURRENT GRADE, CITY, PHONE NUMBER, or the entry will be deemed incomplete and will not qualify. Multiple entries are allowed, but information of the person referred must not be a duplicate. [Entries will be accepted online starting April 27, 2020, 7 a.m. Central Time and ending August 31, 2020, 5 p.m.Central Time.]
- ODDS OF WINNING: The odds of winning this Contest and/or prize will depend upon the number of Contest Participants.
- ELIGIBILITY: This contest is open to legal residents of the State of Texas who are over the age of 18 at the time of entry. Employees of KIPP Texas and their families are eligible to participate in this Contest. Void where prohibited by law. Participants residing in those areas where the contest is void may submit a referral but may not win any prizes. Anyone submitting false information will be disqualified.
- WINNER SELECTION: Winner of the contest will be selected via random drawing using a third-party app not affiliated with KIPP Texas Public School.
- PRIZES: One winner will be selected via random drawing every Friday starting May 1, 2020 through September 4, 2020, and win a $25 gift card (to Walmart). The winner cannot be a previous drawing winner. Prize is not transferrable. Prize is not redeemable for cash value. Prize is not available to KIPP Texas employees.
- WINNER NOTIFICATION: Winner will be notified via email every Monday, starting May 4, 2020, through September 7, 2020. The winner is required to respond to the email notification within 48 hours. KIPP Texas Public Schools shall have no liability for Winner’s failure to receive notices due to spam, junk email or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner is unable to be notified, does not respond to the email notification within 48 hours or is ineligible, an alternate winner will be selected at random from all remaining eligible entries. Inability to contact a winner will result in disqualification.
- GENERAL CONDITIONS: Unless prohibited by applicable law, Participants hereby grant KIPP Texas Public Schools a non-exclusive, perpetual, worldwide license to broadcast, publish, store, reproduce, distribute, syndicate, and otherwise use and exhibit the Submission (along with their names, voices, performance and/or likenesses) in all media now known and later come into being for purposes of trade or advertising without further compensation. Participants represent and warrant that they have full legal rights, power, and authority to grant KIPP Texas Public Schools the foregoing license and if applicable, have secured all necessary rights from any participants in, and contributors to, their submission in order to grant such a license.
- USE OF CONTEST INFORMATION: All entries become the property of KIPP Texas Public Schools. KIPP Texas Public Schools reserves the right to use any and all information related to the contest, including submissions provided by the contestants, for editorial, marketing, and any other purpose, unless prohibited by law.
- NOT ENDORSED BY FACEBOOK, INSTAGRAM, TWITTER, HEB, or WALMART: By participating in this contest, you acknowledge that this contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Twitter, and Walmart and release Facebook, Instagram, Twitter, and Walmart from any and all liability arising from or related to this contest. The information you are providing for this contest is being provided to KIPP Texas Public Schools and not to Facebook, Instagram, Twitter, and Walmart and will be used to notify you if you have won, and to inform you about KIPP Texas Public Schools related content from KIPP Texas Public Schools and our trusted partners.
- CONDUCT: All contest participants agree to be bound by these Official Rules. KIPP Texas Public Schools in its sole discretion reserves the right to disqualify any person it finds to be tampering with the entry process, the operation of its web site or is otherwise in violation of these rules.
- LIMITATIONS OF LIABILITY: Even if alleged to be caused by the sole or partial negligence of KIPP Texas Public Schools, KIPP Texas Public Schools is not responsible for any problems which affect or result from Participation or attempted Participation in the Contest. This includes, but is not limited to, computer, online, telephone or technical malfunctions that may occur. KIPP Texas Public Schools is not responsible for problems with Contest entries, including, but not limited to, entries which are lost, late, incomplete, or cannot be completed due to electronic or technical difficulties, even if the problem is a result of the sole or partial negligence of KIPP Texas Public Schools. If for any reason, the contest is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, KIPP Texas Public Schools may cancel, terminate, modify or suspend the contest.
- RELEASE OF LIABILITY AND INDEMNIFICATION: In consideration for participation in this Contest, all Participants agree to INDEMNIFY, HOLD HARMLESS FROM, and WAIVE AGAINST KIPP TEXAS PUBLIC SCHOOLS, ITS TRUSTEES, EMPLOYEES, OFFICERS, AND AGENTS, BOTH IN THEIR OFFICIAL AND INDIVIDUAL CAPACITIES, ANY AND ALL CLAIMS FOR DAMAGES, INJURIES, OR LOSSES ARISING FROM OR IN ANY WAY RELATED TO PARTICIPATION OR ATTEMPTED PARTICIPATION IN THIS CONTEST WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE OR STRICT LIABILITY IN ANY FORM OF KIPP TEXAS PUBLIC SCHOOLS, ITS TRUSTEES, EMPLOYEES, OFFICERS, AND/OR AGENTS.
- GOVERNING LAW AND JURISDICTION: This Contest shall be governed by and construed in accordance with the laws of the State of Texas, without reference to its conflict of laws principles. By entering this Contest, Participants hereby submit to the jurisdiction and venue of the federal and state courts of Texas and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.
